Terms of Service
Last updated October 23, 2026
Draft for review. This text is being finalized before Buildara's public launch.
1. Agreement
These Terms of Service are an agreement between you and Buildara LLC, a Utah limited liability company ("Buildara," "we," "us"). They cover your use of the Buildara website and software (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
You must be at least 18 years old and able to enter a binding contract to use the Service. If you use the Service for a company or other organization, you agree to these Terms on its behalf.
2. What Buildara is, and isn't
Buildara is software that helps people plan, budget and organize residential construction projects. It is a tool. Buildara is not a contractor, architect, engineer, lender, accountant, attorney, inspector or insurance provider, and does not perform, supervise or guarantee any construction work.
You are responsible for your project: hiring and managing the people who work on it, permits and inspections, building codes, safety, contracts, payments, lien rights and waivers, tax reporting, insurance, and your loan terms. Check the requirements that apply where you build, and get professional advice when you need it.
3. Estimates, schedules and AI-generated information
Cost estimates, price guidance, schedules, quantities, scores, alerts and other information in the Service (including anything produced by artificial intelligence) are general information to help you plan. They can be incomplete or wrong, and actual costs, durations and results will differ. Don't rely on them as a bid, appraisal, engineering review, code review or professional opinion. Confirm anything important with qualified professionals and your own trade partners before acting on it.
4. Your account
Keep your sign-in email secure; anyone with access to it can sign in to your account. You're responsible for activity in your account, including by people you invite to your projects. Give accurate information, and tell us promptly at support@buildara.co if you think your account has been misused.
5. Your content
You own the information and files you put into the Service, such as project details, budgets, plans, photos and documents ("Your Content"). You give Buildara a limited license to store, copy, process and display Your Content only as needed to run, secure and improve the Service for you and the people you choose to share it with, including sending it to our service providers for that purpose.
You confirm you have the right to upload Your Content and that it doesn't break the law or anyone else's rights. When you invite someone to a project, they can see (and, if you allow, change) that project's content.
6. Acceptable use
Don't misuse the Service. In particular, don't: break the law or help anyone else do so; upload malware or content you don't have the right to share; try to access accounts or data that aren't yours; interfere with or overload the Service; copy, resell or redistribute the Service or its data; or reverse engineer, decompile, scrape or otherwise attempt to extract the Service's source code, cost data, prompts or methods, or use them to build a competing product.
7. Free periods, plans and changes
New accounts may receive a free period, shown in your account. We won't charge you automatically when it ends; you'll choose whether to subscribe. Paid plans, prices and what each plan includes are shown in the Service and may change. Some features have usage limits. We'll give you notice before a price change affects you.
The Service will change over time. We may add, change or remove features, and some features may be offered for a limited time or in beta.
8. Third-party services
The Service relies on outside providers (for example hosting, email and AI processing) and may link to other websites or products. We aren't responsible for third-party sites or products, and your dealings with vendors, trade partners and lenders are between you and them.
9. Our property
The Service, including its software, design, cost data, text and the Buildara name and logo, belongs to Buildara or its licensors and is protected by law. These Terms don't give you any rights to it beyond using the Service as allowed here. If you send us feedback or ideas, we may use them without owing you anything.
10. Ending your account
You can delete your account at any time from your account settings, and you can export your data first. We may suspend or close accounts that break these Terms or put the Service or other people at risk. Sections that by their nature should survive (such as ownership, disclaimers, limits of liability and governing law) survive after your account ends.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, BUILDARA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT DATA WILL NEVER BE LOST; KEEP YOUR OWN COPIES OF IMPORTANT DOCUMENTS.
12. Limit of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, BUILDARA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, CONSTRUCTION COSTS, COST OVERRUNS, DELAYS, DEFECTS OR LOST DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.
13. Indemnity
You'll defend and hold Buildara harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your construction project, Your Content, or your breach of these Terms, except to the extent caused by Buildara.
14. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Salt Lake County, Utah, and you and Buildara agree to those courts' jurisdiction.
15. Changes to these Terms
We may update these Terms. If a change is material, we'll ask you to agree to the new version in the Service before you continue using it. The date at the top shows when they last changed.
